Rules of the Maxim service bonus program
E-hailing Service “Maxim” offers a variety of attractive Bonus programs to its new and existing Clients, who have activated their account. Bonuses and/or financial awards and/or Promotions (“Bonuses”) rewarded to Clients are part of the Service’s Promotions program. These Bonuses are limited time offers and their conditions may be subject to changes upon discretion of the Service by notifying the Clients upon modifications of substantial parts of the conditions of the agreement. Prior to accepting any Bonus offers, Clients will be given the opportunity to consider the terms & conditions associated with each Bonus to fully understand how the scheme works (as well as its T&C) and provide their consent regarding the acceptance of any possible alterations.
The Clients are not required to accept any Bonuses offered by the Service; all Bonuses are optional. If the Clients will choose not to accept a Bonus, under these circumstances, the Clients will not be bound to the terms & conditions relating to that Bonus. By accepting the offered Bonuses, the Clients will be bound by the guidelines, provisions and terms of the Bonus programs, if they have fully understood and agreed to the terms and conditions of this agreement.
These terms & conditions shall apply to all the users of Maxim and TaxSee Driver mobile application which will constitute Service’s official offer.
Definition
The following wordings shall be defined in the terms and conditions as follows: -
i) "Participant" is a user of the Maxim or TaxSee Driver mobile application;
ii) “New participant” is a user who has installed the Maxim or TaxSee Driver mobile application for the first time, has never made any orders via the mobile application from their mobile device or phone number and has never activated any promo code;
iii) “Promo code” is a sequence of letters and digits generated in the mobile application and intended to be exchanged between bonus program participants. A promo code identifies its sender and receiver, provides bonuses, and enables participation in Service’s promotion program. It can be only used in the country it was generated for. To activate a promo code, enter it in the corresponding field in the mobile application.
iv) "Bonus ringgit" is a currency unit calculated in Ringgit Malaysia (1 bonus ringgit equals to 1 Ringgit Malaysia) that can be used to pay up to 30% of a ride price. Bonus ringgits cannot be exchanged for actual money and are valid for a limited period as determined by the terms and conditions.
v) “Personal account” means an account created in the Maxim or TaxSee Driver mobile application which is used to record advance payments and amounts debited or credited;
Bonus types:
i) “New user bonus” - a new participant enters a promo code in the Maxim mobile application from the Service’s promotional materials. Once the promo code is successfully activated, 7 bonus ringgits are credited to the participant’s account and can be used to pay for rides within 90 days from the date of activation.
ii) “Bonuses for your friends” - a participant generates a personal promo code in the Maxim mobile application and gives it to a new participant. After activating the promo code in the application on one’s mobile device, the new (receiving) participant receives 7 bonus ringgits. The existing participant receives 7 bonus ringgits for each activation of his/her promo code by the new participant if the new participant makes at least three (3) bookings via the Maxim mobile application within 90 days. Bonus ringgits are credited to the personal account and can be used to pay for the bookings within 90 days.
iii) “Campaign promo code”- a user of the Maxim mobile application receives a promo code for participating in the Service’s promotional campaign. After activating the promo code, the user becomes a promotion participant. Bonus ringgits are not credited for activating the promo code.
iv) “Prize promo code” - a user of the Maxim mobile application receives a promo code as a prize for participating in the Service’s promotion. After activating the promo code, bonus ringgits are credited to the personal account which can be used to pay for the bookings. The number and expiration date of the bonus ringgits are determined by the terms of the promotion.
v) "Gift promo code" - a user of the Maxim mobile application generates a code using the "Create a gift promo code" button and specifies its value in bonus ringgit him-/herself. The amount of money in Ringgit Malaysia equal to the amount of bonus ringgits is withdrawn from his/her personal account or a linked bank card. The user gives his/her promo code to a recipient in any way convenient for him/her. The recipient can activate the promo code. After the activation, the bonus ringgits amounting to the value of a gift promo code are credited to the recipient's personal account.
Indemnification
Clients shall indemnify, defend and hold harmless the Service, its affiliates and respective employees, officers and managers (“Indemnitees”) against all harm, loss, claims, damages, costs, expenses, fines, penalties, levies, demands (including any direct, indirect or consequential losses, loss of profit, loss of reputation and all interest, penalties and legal costs (calculated on a full indemnity basis) and all other professional costs and expenses) and other liabilities suffered or incurred by the Service’s Indemnitees arising out of, resulting from or in connection with:
i) Clients’ participation in the Bonus or Promotion Program;
ii) Clients’ breach of any representation, warranties, covenants, undertakings, agreements or obligations hereunder;
iii) Clients’ failure to comply with any and all applicable laws that apply to Clients, including but not limited to all applicable data protection legislation;
iv) Acts or omissions of fraud or fraudulent misrepresentation of the Clients;
v) Any personal injury or death caused by an act or omission of the Clients;
vi) Any loss or damage suffered directly or indirectly by the Service’s Indemnitee's;
vii) Any allegation or claim of negligence or willful misconduct arising from any act or omission of the Clients; and
viii) Any tax demands or other charges or contributions relating to Clients’ participation in the Bonus or Promotion Program.
Special Conditions
i) The acceptance to the reception of the Bonus or awards, terms and conditions, bind the Client to the terms and conditions hereabove and hereinafter;
ii) The Service shall provide the latest information on the terms and conditions of the bonus or any other promotions time to time, its validity period and its eligibility requirements in its social media accounts or in its mobile application or on the website: taximaxim.com.
