Rules of the Maxim service bonus program


​1. Purpose and Scope

1.1. These Rules constitute the official offer of the “Maxim” service bonus program in the Dominican Republic. 
1.2. Their purpose is to inform the consumer about the mechanics, conditions, limits, and customer service channels of the promotions, in compliance with Law No. 358-05 on Consumer Protection and its implementing regulation, Decree No. 236-08.
1.3. These Rules apply to all promotions, promotional codes, and bonuses generated or activated in the Maxim application within the territory of the Dominican Republic.

2. Legal Nature of Bonuses
2.1. Bonus pesos and gift pesos are promotional units equivalent to Dominican pesos, created exclusively to obtain discounts or promotional payments within the Maxim application. 
2.2. They do not constitute electronic money, deposits, regulated means of payment, or redeemable cash value.
2.3. They do not generate interest, are non-transferable and non-negotiable, except as expressly provided for the “Gift Promotional Code.”
2.4. Their use is limited to the conditions and deadlines established in these Rules and in the corresponding promotional materials.

3. Definitions
3.1. User: User of the “Maxim” service application. 
3.2. New User: A user who uses “Maxim” for the first time and, verified by Maxim, has not placed orders, activated promotional codes, or maintained accounts linked to their identity, payment method, or device in the previous 15 days. 3.3. User: A natural person who requests “Maxim” services in accordance with the Terms of Use and the Public Offer. 3.4. Promotional Code: Alphanumeric sequence generated for individual use and/or exchange between Users, with traceability of the issuer and recipient. Usable only in the country and area for which it was generated. Resale or automated activation is prohibited. 
3.5. Bonus Peso: Promotional unit equivalent to Dominican Peso (RD$), applicable as a discount of up to 15% of the total order price (including taxes and fees), non-refundable in cash, with a limited usage period.
3.6. Gift Peso: Promotional unit equivalent to DOP 1, applicable up to 100% of the total order price, subject to availability and the nominal value credited.
3.7. Personal Account: Record in the app where advances, credits, deductions, and promotion traceability are stored.
3.8. Discount: Reduction applied to the total order price in accordance with these Rules.
3.9. Promotions: Advertising or promotional events announced by “Maxim” that grant codes, discounts, or other benefits in accordance with these Rules.

4. Minimum Elements of Each Promotion
4.1. Every promotion must clearly and sufficiently inform:
    • 4.1.1. Validity: local date and time (AST) of start and end.
    • 4.1.2. Mechanics and requirements: steps to participate and eligibility conditions.
    • 4.1.3. Amount/percentage/nominal value: exact benefit offered.
    • 4.1.4. Limits per order and per user: application and accumulation limits.
    • 4.1.5. Eligible services and exclusions: available rates and services not included.
    • 4.1.6. Conditions of accumulation/non-accumulation: whether it can be combined with other promotions.
    • 4.1.7. Credit and usage deadlines: maximum time to activate and consume the bonus.
    • 4.1.8. Consultation and claim channels: email, phone, and support module in the app.
4.2. The application will show the user, before confirming the order:
    • 4.2.1. The total price includes taxes and fees.
    • 4.2.2. The amount of bonus applied.
    • 4.2.3. The final price to be paid.

5. Types of Bonuses
5.1. First Bonus
5.1.1. A New User enters a promotional code from official “Maxim” service materials in the application.
5.1.2. After successful activation, the specified amount of bonus pesos will be credited to their account.
5.1.3. These pesos may be used to pay for rides within 15 days following the credit, counted from the local date and time (AST).
5.1.4. The maximum applicable discount will be 15% of the total order price.
5.2. New Bonus
5.2.1. Applies to a New User and/or a User who has not placed orders or activated promotional codes in the 15 days prior to activation.
5.2.2. After successful activation, the corresponding amount of bonus pesos will be credited to their account.
5.2.3. The pesos may be used to pay for rides within 15 days following the credit.
5.2.4. The maximum applicable discount will be 15% of the total order price.
5.3. Gift for a Friend
5.3.1. A User receives a promotional code assigned in the application and shares it with a New User.
5.3.2. After activation of the code, the New User receives 750 bonus pesos.
5.3.3. The User shall be entitled to receive a bonus of 75 Dominican pesos for each valid activation of their personal code, provided that the referred new user has completed at least 3 duly executed and confirmed orders within a maximum period of 90 days from the date of registration.
5.3.4. Credited pesos may be used within 15 days following the credit.
5.3.5. Maxim may verify the validity of the activation and block accounts in case of fraud or misuse.
5.4. Participation Promotional Code
5.4.1. A user receives a promotional code to participate in a “Maxim” promotional offer.
5.4.2. After activation, the user becomes a Participant of the offer, without crediting bonus or gift pesos.
5.4.3. The terms and conditions of the offer, including validity and benefits, will be informed in advance in the application and on the website.
5.5. Prize Promotional Code
5.5.1. A user receives a promotional code as a prize for participating in a promotion.
5.5.2. After activation, gift pesos will be credited to the user’s personal account.
5.5.3. The nominal value and usage period will be determined by the conditions of the promotion.
5.5.4. Gift pesos may cover up to 100% of the order price, subject to the credited value.
5.6. User’s Birthday
5.6.1. The promotion applies to users who have registered their date of birth in the application or on the website taximaxim.com.
5.6.2. On the User’s birthday, an amount equivalent to 10% of the value of rides actually taken and paid for on that date will be credited to their account, provided the User’s date of birth has been previously registered in the Application.
5.6.3. Bonus funds may be used to cover up to 15% of the cost of an order within 15 days following the credit date.
5.6.4. Maxim may require identity verification to validate the date of birth.

6. Conditions of Use, Limits, and Prohibitions
6.1. Bonuses apply only to rates available in the Maxim application and may exclude special services, zones, or schedules determined for operational reasons.
6.2. Maxim may establish daily and monthly limits on the crediting and redemption of bonus and gift pesos per user, informed in advance in the application.
6.3. The following are prohibited:
    • 6.3.1. Creating multiple accounts for the same user.
    • 6.3.2. Reselling or auctioning promotional codes.
    • 6.3.3. Automating activations through software or external devices.
    • 6.3.4. Manipulating identity, location, or device data to obtain undue benefits.
6.4. Maxim may suspend accounts and cancel bonuses obtained improperly, notifying the user and recording it in their personal account.

7. Responsible Advertising
7.1. The promotional materials of the program must be truthful, clear, and sufficient, avoiding misleading the consumer. 
7.2. Terms such as “free” or “100%” may only be used when the order can indeed be fully covered with gift pesos under the applicable conditions. 
7.3. Relevant restrictions (validity, 15% cap for bonuses, expiration, eligibility) must be prominently displayed in the application and in the promotional materials.

8. Amendments to the Rules
8.1. Maxim may amend these Rules and/or promotions with at least five (5) days’ prior notice by publishing them in the application and on the website taximaxim.com/app. 
8.2. Changes will not retroactively affect bonuses already credited under the conditions in force at the time of their granting.

9. Applicable Law, Jurisdiction, and Interpretation
9.1. These Rules are governed by the law of the Dominican Republic. 
9.2. Disputes arising from the interpretation or application of these Rules will be submitted to the courts of the National District. 
9.3. In case of ambiguity or contradiction, the interpretation most favorable to the consumer shall apply, without prejudice to the anti-fraud measures provided in these Rules.
