Maxim Service Bonus Program Contract (Dominican Republic)

1. Purpose and Scope
1.1. AIST Dominicana , SRL 'Maxim' service bonus program in the Dominican Republic.
1.2. Its purpose is to inform the consumer about the mechanics, conditions, limits and customer service channels of the promotions, in compliance with Law No. 358 ‑05 on Consumer Protection and its implementing regulations, Decree No. 23608.
1.3. These Stipulations apply to all promotions, promotional codes and bonuses generated or activated in the application that will be used by AIST Dominicana , SRL, called 'Maxim - Viajes & Envíos' (hereinafter Maxim) within the territory of the Dominican Republic.

2. Legal Nature of the Bonuses
2.1. Bonus pesos and gift pesos are promotional units equivalent to Dominican pesos, created exclusively to obtain discounts or promotional payments within the Maxim app. The differences and specifications of both concepts are detailed in sections 3.4 and 3.5 of this document.
2.2. They do not constitute electronic money, a deposit, a regulated means of payment or a cash redeemable value.
2.3. They do not generate interest, are not transferable or negotiable, except as expressly provided for the “Gift Promotional Code”.
2.4. Its use is limited to the conditions and time limits set out in these Stipulations and in the corresponding promotional materials.

3. Definitions
3.1. User: User of the “Maxim” service application, who requests services from it in accordance with the Terms of Use and the Public Offer.
3.2 User who uses “Maxim” for the first time and who, after verification by Maxim, has not placed orders or activated promotional codes , nor has maintained —in the last fifteen (15) calendar days— other accounts linked to their identity, to any previously registered payment method (including bank cards, electronic wallets or their tokenized identifiers ) or to their mobile device.
3.3. Promotional Code: An alphanumeric sequence generated for individual use or exchange between Users, with traceability of the sender and recipient. Usable only in the country and area for which it was generated. Resale or automated activation is prohibited.
3.4. Bonus Weight: Promotional unit equivalent to one (1) Dominican peso (RD$), applicable as a discount of up to 15% of the total order price (taxes included), non-refundable in cash, with a limited usage period of 15 calendar days after its crediting.
3.5. Gift Weight: Promotional unit equivalent to one (1) Dominican peso (RD$), applicable up to 100% of the total order price, subject to availability and the credited nominal value.
3.6. Personal Account: Registration in the app where advances, credits, deductions and traceability of promotions are recorded.
3.7. Discount: Reduction applied to the total price of the order in accordance with these Stipulations.
3.8. Promotions: Advertising or promotional events announced by “Maxim” that grant codes, discounts or other benefits in accordance with these Stipulations.

4. Minimum Elements of Each Promotion
4.1. All promotions must clearly and sufficiently inform:
    • 4.1.1. Validity: local date and time (AST) of start and end.
    • 4.1.2. Mechanics and requirements: steps to participate and eligibility conditions.
    • 4.1.3. Amount/percentage/nominal value: exact benefit offered.
    • 4.1.4. Limits per order and per user: application and accumulation limits.
    • 4.1.5. Eligible services and exclusions: available rates and services not included.
    • 4.1.6. Accumulation/non-accumulation conditions: whether it can be combined with other promotions.
    • 4.1.7. Accreditation and usage periods: maximum time to activate and consume the bonus.
    • 4.1.8. Consultation and complaint channels: email, telephone and support module in the app .

4.2. The application will show the user, before confirming the order:
    • 4.2.1. The total price including taxes.
    • 4.2.2. The amount of bonus applied.
    • 4.2.3. The final price to pay .

5. Types of Bonuses
5.1. First Bonus
5.1.1. A New User enters a promotional code from official “Maxim” service materials into the application.
5.1.2. After successful activation, the bonus amount specified in the promotional material will be credited to your account.
5.1.3. These pesos may be used to pay for travel within 15 calendar days following accreditation, calculated from the local date and time (AST).
5.1.4. The maximum applicable discount will be 15% of the total order price.
5.2. New Bonus
5.2.1. Applies to a New User or a User who has not placed orders or activated promotional codes in the 15 calendar days prior to activation.
5.2.2. After successful activation, the corresponding bonus amount in pesos will be credited to your account.
5.2.3. The pesos may be used to pay for travel within 15 calendar days following accreditation.
5.2.4. The maximum applicable discount will be 15% of the total order price.
5.3. Gift for a Friend
5.3.1. A User receives an assigned promotional code in the application and shares it with a New User. It is important to specify that what is shared is the promotional code, not the bonus.
5.3.2. After the code is activated, the New User receives a bonus of 750 pesos.
5.3.3. The User will be entitled to receive a bonus equivalent to 75 Dominican pesos for each valid activation of their personal code, provided that the new referred user has completed, within a maximum period of 90 calendar days from their registration, at least 3 orders effectively made and confirmed.
5.3.4. The credited pesos may be used within 15 calendar days following the crediting.
5.3.5. Maxim may verify the validity of the activation and block accounts in case of fraud or misuse.
The procedure to follow for applying the block will be the following:
a. Start of the procedure
    • Maxim may initiate a verification process when there are reasonable indications of fraud or misuse of the application.
    • An internal report will be drawn up to initiate the process, describing the irregularities detected.
b. Preventive blocking and user notification
    • From the moment the user is notified, their account will be blocked preventively to avoid risks of continued fraud or misuse.
    • The notification must include:
        ◦ The facts that motivate the verification.
        ◦ The preventive measure applied (temporary block).
        ◦ The possible consequence of a permanent blockade.
        ◦ The time period granted to exercise your right to defense.
c. Defense period
    • The user will have a period of 5 working days to present their allegations, evidence or explanations.
    • The defense may be carried out by:
        ◦ Written response via email.
        ◦ Form enabled in the application.
        ◦ Additional documentation that supports the legitimacy of its use.
d. Evaluation
    • Maxim will analyze the information submitted by the user along with internal records.
    • The maximum period for issuing a resolution will be 10 working days from the receipt of the defense.
e. Resolution
    • The decision must be justified and notified to the user.
    • It may consist of:
        ◦ Lifting of the preventive block and filing of the procedure if fraud or misuse is not confirmed.
        ◦ Permanent account blocking if fraud or misuse is confirmed.
f. Complaint mechanisms
    • The user may file an appeal for reconsideration within 5 working days following notification of the decision.
    • Maxim must resolve this appeal within a maximum of 10 working days.
    • If the dissatisfaction persists, the user may contact the competent consumer protection authorities.
5.4. Promotional Participation Code
5.4.1. A user receives a promotional code to participate in a promotional offer of the “Maxim” service, according to the definition of the service established in point 1.5 of the Public Offer document – Terms of Use of AIST DOMINICANA, SRL – MAXIM.
5.4.2. After activation, the user becomes a User of the offer, without crediting bonus or gift pesos.
5.4.3. The terms and conditions of the offer, including validity and benefits, will be informed in advance in the application and on the website.
5.5. Promotional Prize Code
5.5.1. A user receives a promotional code as a reward for their participation in a promotion.
5.5.2. After activation, gift pesos will be credited to the user's personal account.
5.5.3. The nominal value and the period of use will be determined by the conditions of the promotion.
5.5.4. Gift pesos may cover up to 100% of the order price, subject to the credited value.
5.6. User's Birthday
5.6.1. The promotion applies to users who have registered their date of birth in the application or on the website taximaxim.com.
5.6.2. On the User's birthday, an amount equivalent to 10% of the value of the trips actually made and paid for on that date will be credited to their account, provided that the User's date of birth has been previously registered in the Application.
5.6.3. Bonus funds may be used to cover up to 15% of the cost of an order within 15 calendar days following the date of accreditation.
5.6.4. Maxim may require identity verification to validate the date of birth.

6. Terms of Use, Limits and Prohibitions
6.1. Maxim may establish daily and monthly limits for crediting and redeeming bonus and gift pesos per user, previously informed in the application.
6.2. The following are prohibited:
    • 6.2.1. Create multiple accounts for the same user.
    • 6.2.2. Resell or auction promotional codes.
    • 6.2.3. Automate activations using software or external devices.
    • 6.2.4. Manipulating identity, location or device data to obtain undue benefits.
6.3. Maxim may suspend accounts and cancel bonuses obtained improperly, notifying the user and leaving a record in their personal account.

7. Responsible Advertising
7.1. The program's promotional materials must be truthful, clear and sufficient, avoiding misleading the consumer.
7.2. Terms such as “free” or “100%” may only be used when the order can actually be fully covered with gift credits under the applicable conditions. Promotions will be clearly detailed in the application, indicating their validity and specific conditions. The User agrees that the Company may notify them about these promotions through push notifications in the application or phone calls to the registered number, which will be considered valid at the time of issuance. Push notifications will appear briefly on the screen—for approximately five seconds upon accessing the application—and will subsequently remain available in the device's notification center for review at any time.
7.3. Relevant restrictions (validity, 15% bonus cap, expiry, eligibility) must be prominently displayed in the application and in advertising materials.

8. Modifications to the Stipulations
8.1. Maxim may modify promotions with a minimum of five (5) calendar days' prior notice by publishing them on the application and on the website taximaxim.com/app .
8.2. The changes will not retroactively affect bonuses already credited under the conditions in force at the time of their granting.

9. Applicable Law, Jurisdiction and Interpretation
9.1. These Stipulations are governed by the law of the Dominican Republic.
9.2. Disputes arising from the interpretation or application of this contract may, in the first instance, be submitted to a conciliation process between the parties, with the aim of reaching an amicable solution. Should the conciliation process fail, the dissenting party may resort to the jurisdiction of the courts of the National District.
9.3. In case of ambiguity or contradiction, the interpretation most favorable to the consumer shall apply, without prejudice to the anti-fraud measures provided for in these Stipulations.
